South Carolina drivers who own utility terrain vehicles will gain new road privileges starting November 18, when a state law making qualifying UTVs street-legal on certain public roads officially takes effect. Until that date, operating one of these off-road vehicles on a public street remains illegal and subject to a citation.
The law defines a qualifying UTV narrowly. To be eligible, the vehicle must be a four-wheel-drive, side-by-side design intended to carry people, cargo, or both, with a top speed above 55 miles per hour and an engine of at least 450 cubic centimeters. It also must weigh no more than 4,000 pounds fully loaded, measure 80 inches or less in width, use a steering wheel rather than handlebars, and have non-straddle seating.
Owners planning to drive on public roads will need to title and register the vehicle through the South Carolina Department of Motor Vehicles and carry liability insurance, just as they would for a car or truck. Those who intend to keep their UTV strictly on private property or trails are not required to register it or purchase insurance under the new law.
Equipment requirements are also part of the law. Qualifying UTVs must be outfitted with working headlights, tail lights, brake lights, and turn signals before they can legally use the road. Every seating position must have a Type 2 seat belt, and the law sets a minimum driver age of 17.
State transportation officials say the change reflects the growing popularity of UTVs in rural and agricultural parts of the state, where residents have increasingly used them for short trips between properties, hunting land, and farm work. Enforcement will fall to local and state law enforcement agencies once the law takes effect.
Residents who already own a UTV and want to drive it on public roads this fall have a roughly two-month window to get their paperwork and equipment upgrades in order before enforcement begins. Officials are encouraging owners to start the registration and insurance process early, since demand at DMV offices is expected to increase as the effective date approaches.
